Electronic Transactions Policy – Consent to Electronic
Delivery and Use of Electronic Signatures
THIS DISCLOSURE AND CONSENT (“CONSENT”) CONTAINS
IMPORTANT INFORMATION WHICH YOU AS AN EQUITABLE TRUST COMPANY CLIENT ARE
ENTITLED TO RECEIVE BEFORE YOU AGREE TO ELECTRONIC DELIVERY OF RECORDS. YOUR
CONSENT PERMITS THE GENERAL USE OF ELECTRONIC RECORDS AND ELECTRONIC
SIGNATURES. PLEASE READ THIS NOTICE CAREFULLY AND PRINT OR DOWNLOAD A COPY FOR
YOUR FILES.
Scope of Consent
By giving consent, you, (“Client”) elect
to receive documents and records by electronic delivery and other electronic
methods, including online access via a computer or mobile device. Documents and
records may include, but are not limited to: account statements, periodic client
communications, regulatory notices, and tax documents, such as IRS Form 1099’s.
Client further agrees that
electronic signatures are sufficient to execute this agreement and any document
provided by Equitable Trust that requires a signature. Such electronic
signatures shall have the same force and effect as manual signatures. The parties
further agree that electronic signatures may be obtained via any electronic
method whether now known or hereafter developed, including facsimile and
electronic mail (including in .pdf format or through any process complying with
the U.S. federal ESIGN Act of 2000, such as those provided by private third
parties such as docusign.com). For purposes of this consent, the term
“electronic signature” means any electronic symbol, sound, or process attached
to or logically associated with a record and executed and adopted by a party
with the intent to sign any record or other material.
This Consent is effective until
withdrawn by Client. By logging in to Equitable Trust’s online account
access, Client acknowledges that he/she has read and understands this Consent,
and that Client is able to access, view, receive, print, and retain documents
and records electronically. If Client does not specifically consent to the
electronic delivery of documents and records, Equitable Trust will default to
paper delivery of all required documents and records.
How to Update Your Contact Information
Client agrees to provide Equitable
Trust with accurate personal contact information and to promptly notify
Equitable Trust with any changes. Client may contact any client service
representative or Equitable Trust Company employee to update contact
information.
Hardware and Software Requirements
In order to receive electronic
delivery of documents and records and use electronic signatures, Client must
have access to the following technology:

A current version of an internet browser, such
as Safari, Chrome, or Firefox. Current version is a version of the software
that is currently supported by its publisher.

A connection to the internet
·
A current version of a program that accurately
reads and displays PDF files
·
A computer and operating system capable of
supporting all of the above.
Client will also need a working
email account to receive, view, sign, and print documents and records.
Retain a Copy for Your Records
We recommend that you print or
download a copy of this Consent to Electronic Delivery and Use of Electronic
Signatures.
